THIS CAUSE having come on to be heard on 26 June 2003 on Defendant’s Motion to Dismiss as to Assignment of Benefits and the court having heard argument of counsel, and being otherwise advised in the premises, it is hereupon

ORDERED AND ADJUDGED that said Motion be, and the same is hereby Denied. Assignment need not state Progressive Express Insurance Company to be valid. Defendant has ten (10) days to submit answer.
