SUMMARY JUDGMENT

THIS CAUSE, having come before the Court on Defendant’s Motion For Summary Judgment on May 22, 2003, and the Court having considered the pleading, and being otherwise fully advised in the premises, it is therefore ORDERED and ADJUDGED:

1. That Defendant is entitled to Summary Judgment as a matter of law as to CPT code 99080, submitted March 2, 2001, under the coding for a “special report”;

2. That CPT code 99080 is not a code associated with providing a “medical service”, and is therefore not compensable under Section 627.736;

3. That Plaintiff take nothing by this action and that Defendant go hence without day.
