In reviewing the file and reflecting upon the argument of counsel, the Court concludes that it erred in its May 8, 2003 Order. As Plaintiff complied with Section 57.105(4), Florida Statutes, the Court neither should have heard Defendant’s motion, nor granted the relief.
The Court is not unmindful of the efforts expended by counsel. Having reviewed this issue at length, however, during each of several discovery disputes, it is now clear that the Order of May 8, 2003 cannot stand. Therefore, it is incumbent upon the Court to correct its action.
No further motions will be considered. This case shall be closed.
