This cause having come to be heard before this Court December 10, 2002 on the Defendant’s Motion for Summary Judgment/Benefits Exhausted, and this Court, having heard argument of counsel, having fully considered the record, and being otherwise fully advised, concludes that Defendant has not shown its entitlement to summary judgment.

In view of the above, it is

ORDERED AND ADJUDGED that Defendant’s Motion for Summary Judgment/Benefits Exhausted is hereby DENIED.
