ORDER
THIS CAUSE having come before the Court and upon the oral Stipulation between the parties on Defendant’s Motion to Compel Deposition of Dr. Henry Floyd without Expert Witness Fee, it is hereby
ORDERED AND ADJUDGED that
1. Defendant’s Motion to Compel Deposition of Dr. Floyd Without Expert Witness Fee is GRANTED.
2. Dr. Floyd shall submit to a deposition to be conducted at his office as a professional courtesy.
3. The deposition of Dr. Floyd will be conducted as originally scheduled on Thursday, July 10, 2003 at 3:00 P. M.
4. If Dr. Floyd is questioned about issues that do not call for his expertise, Dr. Floyd will not be entitled to expert witness fee.
5. If Dr. Floyd is questioned about treatment and diagnoses of Guylaine Edouard, Dr. Floyd arguably might be entitled to expert witness fee based on a subsequent motion made on his behalf.
