THIS MATTER having come on to be heard before the Court on September 19, 2003, on Plaintiff’s Motion for Protective Order, and after hearing argument of counsel and being fully advised of the premises, it is hereby:
ORDERED AND ADJUDGED that the Motion for Protective Order is hereby GRANTED and it is further,
ORDERED:
1. That Dr. Ronald Gold is entitled to receive an expert witness fee for his deposition in this case as a treating physician.
2. If the parties cannot agree on a reasonable fee the Court will set one upon further evidentiary hearing.
