ORDER AWARDING SANCTIONS

THIS CAUSE having come to be heard on Defendant’s Motion to Disqualify, Plaintiff’s Council and the Court having found that this matter was properly noticed for hearing, that Plaintiff’s Council had notice of this hearing, that Defense Council made a special appearance from his Fort Myers office to attend the hearing at 9:00 AM, and that the Plaintiff’s Council having failed to appear without adequate excuse, it is hereupon

ORDERED and ADJUDGED:

1. That the court hereby sanctions attorney Brian Korte for his failure to appear.

2. That Brian Korte shall pay to Progressive Express Insurance Company the sum of $400.00.
