ORDER ON DEFENDANT’S MOTION TO DISMISS FOR FAILURE TO COMPLY WITH DISCOVERY ORDER

THIS CAUSE, having come on before this Court on August 4, 2004, upon the Defendant’s Motion to Dismiss For Failure to Comply With Discovery Order, and the Court having heard argument of counsel for the respective parties, and being otherwise duly advised in the premises, it is hereby

ORDERED AND ADJUDGED that Defendant’s Motion to Dismiss For Failure to Comply With Discovery Order is DENIED. However, the Court awards attorney’s fees to the Defendant for the cost of bringing Defendant’s Motion before the Court, to be paid by Plaintiff to the Defendant. The Court reserves jurisdiction as to the amount of attorney’s fees to be awarded.
