ORDER ON MOTION FOR PROTECTIVE ORDER

THIS CAUSE, having come on before this Court for hearing on February 23, 2005, upon the Motion for Protective Order filed by Francis R. Morse, P.A., and the Court having heard argument of counsel for the respective parties, and being otherwise duly advised in the premises, it is hereby

ORDERED AND ADJUDGED that Francis R. Morse, P.A.’s Motion For Protective Order is DENIED IN PART and GRANTED IN PART.

Francis R. Morse, Esquire is to produce any and all records and documentation reflecting communications of any kind with third-parties, as requested by the Subpoena Duces Tecum Without Deposition dated December 10, 2004, that concerns or pertains to any agreements reached with Barbara Lodato’s examining and/or treating physician(s) pertaining to amounts paid to the providers with regard to the motor vehicle accident of August 14, 2003. However, attorney Morse is not required to produce any records or documentation of privileged communications between himself and his client that are protected under attorney-client privilege.

Francis R. Morse, Esquire shall produce said records and documentation within ten (10) days from the date of the hearing held on February 23, 2005.
