(SCHLESINGER, J., dissenting) I respectfully dissent from the majority opinion in the instant matter. The record of the lower court contains no valid factual explanation for the plaintiff’s failure to attend the requested and required examination under oath (EUO).

Appellant’s motion for attorney’s fees is DENIED.
