ORDER ON PLAINTIFF’S MOTION TO COMPEL BETTER RESPONSES TO PLAINTIFF’S 2ND REQUEST TO PRODUCE

This cause having come before the Court on August 14, 2006, on Plaintiff’s Motion to Compel Better Responses to 2nd Request to Produce, with Timothy A. Patrick, Esquire appearing on behalf of Plaintiff and James Bogos, Esquire appearing on behalf of Defendant, and the Court being fully advised in the premises, rules that for the reasons stated on the record and recorded in open court, which constitutes the decision of this Court,

ORDERS AS FOLLOWS:

1. Plaintiff’s Second Request to Produce requested the following:

Each and every explanation of benefit (EOB) and explanation of reimbursement (EOR) generated by the Defendant for the geozip 336__ for the time period of three (3) months prior to, and three (3) months subsequent to each of the respective dates of service and CPT codes at issue pursuant to the attached Statement of Particulars.

2. The Defendant must produce this information for a three (3) month period during the applicable time frame.

3. The Defendant may re-dact the claimant’s name or any information that would make the claimant identifiable in order to comply with the requirements of HIPPA, other than the names of medical providers.
