ORDER GRANTING MOTION FOR FINAL SUMMARY JUDGMENT

This cause came on for hearing on Plaintiff’s Motion for Final Partial Summary Disposition and on Defendant’s Second Motion for Final Summary Judgment, and the Court, being advised in the premises, finds that Plaintiff’s “Demand Letter” dated August 21, 2003, complies with the requirements of Section 627.736(11), Fla. Stat., therefore, it is

ORDERED AND ADJUDGED:

1. Plaintiff’s Motion for Final Partial Summary Disposition is granted and the Court reserves jurisdiction to award a reasonable fee for services of Plaintiff’s attorney, plus costs in this action.

2. Defendant’s Second Motion for Final Summary Judgment is denied
