ORDER ON DEFENDANT’S DISCOVERY MOTIONS

THIS CAUSE having come before the Court on September 27, 2007 on Defendant’s Motions to Compel Depositions of Celines Rios-Williams, Joseph Flood and Donna Maloney Hansen, the Court having heard arguments by counsels for Plaintiff and Defendant and otherwise being fully advised in the premises, hereby

FINDS, ORDERS AND ADJUDGES:

1. This is a PIP lawsuit for alleged breach of automobile insurance contract.

2. The underlying claim in the above styled lawsuit has been settled.

2. The only issue remaining before the Court is the amount of Plaintiff’s reasonable attorney’s fees and costs.

3. Defendant’s Motion to Compel the Deposition of Plaintiff, Celines Rios-Williams, is moot as Plaintiff has stipulated on the record during the hearing that Plaintiff has had no difficulty in obtaining counsel to represent her in the current case and Defendant has withdrawn its Motion to Compel Plaintiff’s deposition.

4. Defendant’s Motion to Compel the deposition of Joseph Flood, attorney for Plaintiff, is hereby GRANTED.

5. Joseph Flood shall submit for deposition in the current case.

6. Defendant’s Motion to Compel the deposition of Donna Maloney Hansen, attorney for Plaintiff, is hereby GRANTED.

8. Donna Maloney Hansen shall submit for deposition in the current case.
