THIS MATTER having come before this Court on November 5, 2007, on Defendant’s Motion for Final Summary Judgment and Motion for Protective Order, and this Court having heard arguments of counsels and otherwise being advised in the premises, it is hereby:

ORDERED AND ADJUDGED that:

1. Defendant’s Motion for final Summary Judgment is Granted, finding the Plaintiff lacks standing, there being no valid assignment of benefits.
