THIS CAUSE having come on for hearing on August 2, 2007 on defendant’s motion to dismiss Counts II and III of the Complaint herein, and the Court, having had the parties before it and being otherwise fully advised in the premises, it is hereby

ORDERED AND ADJUDGED that said motion be, and the same is hereby DENIED. Defendant has twenty (20) days to file an Amended Answer which will include its responses to Counts II and III therein.
