ORDER ON DEFENDANT’S MOTION TO DISMISS

THIS MATTER having come before the Court at hearing on July 17, 2008 concerning the Defendant’s Motion to Dismiss dated February 11, 2008 and the Court having reviewed the Court file, received argument and case law of counsel finds as follows:

1. This suit is a declaratory action filed pursuant to Florida Statute §86.011.

2. Defendant filed a Motion to Dismiss relying heavily on Hildebrandt v. Department of Natural Resources, 313 So.2d 73 (Fla. 3rd DCA 1975).

3. The Court has reviewed relevant case law and finds it agrees with the reasoning of a majority of Courts.
