Circuit Court, 17th Judicial Circuit (Appellate) in and for Broward County. Case No. 07-5796 CACE (12). L.T. Case No. 06-19067 COCE (54). June 25, 2007. Counsel: Laura J. ORDER GRANTING PETITION FOR WRIT OF CERTIORARI
(DORIAN K. DAMOORGIAN, J.) THIS CAUSE is before the Court on Petition for Writ of Certiorari filed by Petitioner United Automobile Insurance Company. Petitioner is seeking a writ of certiorari quashing an order of the trial court requiring petitioner to provide an additional answer to Interrogatory 3g, which requested the number of examinations performed by the expert physician “for insurance companies generally.”
Based on a review of the record, the parties’ briefs and the applicable case law, this Court grants the petition for writ of certiorari and quashes the order insofar as the order requires petitioner to provide information about a non-party’s use of an expert witness. The respondents may be entitled to discover this information. Allstate Ins. Co. v. Boecher, 733 So.2d 993 (Fla. 1999). However, they will have to address their request to the proper party. See e.g. Colavecchio v. Wilson, 723 So.2d 379 (Fla. 4th DCA 1998).
