THIS CAUSE having come to be heard on September 23, 2010 on Defendant’s Motion to Transfer Venue and Motion for Extension of Time to Respond to the Complaint, in the above-entitled action, and after hearing argument of counsel,
It is hereby ORDERED AND ADJUDGED that:
Defendant’s Motion to Transfer Venue is hereby granted pursuant to American Vehicle Insurance v. Goheagan, 35 So. 3d 1001 (Fla. 4th DCA 2010) [35 Fla. L. Weekly D1171a]. Plaintiff has 30 days to pay the transfer fee and designate whether the case shall be transferred to Pinellas or Orange Co. pursuant to Rule 1.060(b), or this case shall be dismissed without prejudice.
