ORDER ON PLAINTIFFS’ MOTION FORATTORNEY’S FEES AND COSTS

THIS CAUSE having come on to be heard on Plaintiffs’ Motion for Attorney’s Fees and Costs dated June 14, 2012, and the Court having heard evidence and argument of counsel including the testimony of each party’s fees expert, the parties stipulating entitlement as well as the amount of taxable costs and that a prior-ordered payment to Defendant of Sanctions with agreed amount of $454.00 should be deducted as an offset against Plaintiffs’ fees, and being otherwise advised in the premises, it is,

ORDERED AND ADJUDGED that counsel for Plaintiffs, Bert E. Uebele, IV, shall be compensated by Sunshine State as reasonable fees 40.8 hours of time at the hourly rate of $350.00 or $14,280.00, less the stipulated offset of $454.00 as fees owed to Defendant for a net fees award of $13,826.00, together with interest at the legal rate of 4.75% accruing as of April 16, 2012, the date on which entitlement had been stipulated, which if paid by November 15, 2012 would be $381.27 or $1.79/day until paid. Plaintiffs’ counsel shall also be paid $1,040.00 as taxable costs.

The Court also finds that Plaintiffs’ expert Thomas Player should be compensated for 11 hours of time at $350 per hour or $3,850.00, this amount deemed reasonable for his activities in the rendering of his opinions.

Accordingly, Defendant is ordered to pay to Plaintiffs’ counsel the total sum of $19,097.27, counsel to reimburse his expert.
