FINAL JUDGMENT FOR ATTORNEY’SFEES AND COSTS FOR PLAINTIFF
This matter having come before the Court on March 7, 2014, on the Plaintiff, ALL DRY RESTORATION’s Motion for Attorney’s Fees, Costs or Related Expenses, and the Court having reviewed the motion and the court file, having heard the testimony of witnesses including Marilyn Eisler, Esq., Plaintiff’s retained attorney fee expert, Mark Goldstein, Esq., and Defendant’s expert, Steven J. Leiter, Esq., and based upon the stipulations of counsel and other evidence presented to the Court, and being otherwise fully advised in the premises,
The Court hereby FINDS as follows:
1. Plaintiff’s attorney, Marc Ben-Ezra, Esq., is to be awarded 2.50 hours at the hourly rate of $300.00 for a total fee award of $750.00;
2. Plaintiff’s attorney, Asher Perlin, Esq., is to be awarded 0.60 hours at the hourly rate of $300.00. for a total fee award of $180.00;
3. The time appearing on Plaintiff’s counsel’s time sheets on file with the court for attorneys, Jaime Alvarez, Esq. and Nicole Shacket, Esq., have been withdrawn;
4. Plaintiff’s paralegal is to be awarded 1.25 hours at the hourly rate of $100.00 for a total fee award of $125.00;
5. Plaintiff is to recover costs in the total sum of $393.00.
6. Plaintiff’s attorney fee expert, Mark Goldstein, Esq., is entitled to 2.0 hours at the hourly rate of $300.00 per hour for a total expert witness fee of $600.00;
7. The total of Attorneys fees and costs set forth 1-5 above is $1,445.00
8. Plaintiff’s attorney, Marilyn Eisler, Esq., reasonably expended 19.70 hours in this case and $280.00 is a reasonable hourly rate for her services for a total fee award of $5,516.00. This amount shall be added to the sums set forth in paragraphs 6 and 7 above for the total award due to Plaintiff.
IT IS ORDERED AND ADJUDGED as follows:
A. Plaintiff’s claim for a multiplier has been withdrawn.
B. Plaintiff, ALL DRY RESTORATION, shall recover from Defendant, CITIZENS PROPERTY INSURANCE CORPORATION the sum of $6,571.00 for attorney’s fees, $125.00 for paralegal fees, $600.00 for expert witness fees, and $393.00 for costs, making a total of $7,564.00 that shall bear interest at the rate of 4.75% a year, for which let execution issue forthwith.
