ORDERDEFENDANT’S MOTION FOR PROTECTIVEORDER AND OBJECTIONS TO PLAINTIFF’S NOTICEOF TAKING DEPOSITION DUCES TECUM
THIS CAUSE having come on to be heard on ____________, Defendant’s/Plaintiff’s ____________________ Motion for Protective Order and Objections to Plaintiff’s Notice of Taking Deposition Duces Tecum and the Court having heard argument of counsel, and being otherwise advised in the Premises, it is hereupon,
ORDERED AND ADJUDGED that said Motion be, and the same is hereby: Granted in part. The scope of the deposition shall be limited to this case only; however, there may be some overlap with respect to Defendant’s objections to Plaintiff’s Duces Tecum. The parties agree the Defendant will bring its entire claim file, diary notes, correspondence in file and copies of publications (items 2, 4, 5, and 11). Any items not turned over shall be listed on a separate privilege log. Plaintiff to withdraw request for underwriting file (item 9). Defendant is ordered to produce its Decision Point reports evidencing the charges submitted to Defendant by all providers in the Geozip (333) for the listed CPT codes for the year 2009.
