ORDER ON PLAINTIFF’S MOTION TO TOLLPROVISIONS OF DEFENDANT’S INTENT TO FILEMOTION FOR ATTORNEYS’ FEES/COSTS UNDER § 57.105
THIS CAUSE having come before the Court upon Plaintiff’s Motion to Toll Provisions of Defendant’s Intent to File Motion for Attorneys’ Fees/Costs under § 57.105, and after hearing argument of the parties, it is hereby ORDERED AND ADJUDGED that:
1. DENIED. Fla. Stat. § 57.105 is a special statutory proceeding; therefore, trial courts cannot extend the deadlines set forth in § 57.105. See Imperial Fire & Casualty Ins. Co. v. Premium Quality Medical Cntr. Corp., No. 13-177 AP (Fla. 11th. Jud. Cir. Ct. Dec. 4, 2013) [21 Fla. L. Weekly Supp. 125b] (Appellate). Accordingly courts cannot grant motions for extension of time to respond to Motions for Attorneys’ Fees and Costs pursuant to Fla. Stat. § 57.105. Id.
