THIS CAUSE having come on for consideration on Plaintiff’s, LARRY FISHMAN, L.M.T., P.A., as assignee of ANN MARIE ROBINSON, Motion in Limine to Preclude Any Mention of §627.736(5)(a)(2), it is hereby,
ORDERED AND ADJUDGED that said Motion be, and the same is hereby GRANTED as follows:
1. The Defendant shall not mention or ask any witness about Florida Statute 627.736(5)(a)(2).
2. Insurers that have amended their policy based on Florida Statute 627.736(5)(a)(2) are not relevant. Defendant is not to reference payments by insurers who have utilized the Florida Statute 627.736(5)(a)(2) limitation, as it is also more prejudicial than probative.
