ORDER DENYING DEFENDANT’S MOTION FORPARTIAL SUMMARY JUDGMENT

This cause came to be heard before the Court on April 14, 2015 on Defendant’s Motion for Partial Summary Judgment, and the Court having heard the argument of counsel, and having considered the pleadings, affidavits and exhibits properly presented before the Court, and being otherwise informed,

IT IS THEREFORE ORDERED that the Defendant’s Motion for Partial Summary is DENIED.

At the hearing on Defendant’s Motion, the Defendant requested this Court to find that the assignment of benefits at issue unambiguously assigned the entire policy to the Plaintiff. The Court disagrees. The Court finds that the assignment of benefits unambiguously assigns only the rights and benefits under the policy for the services rendered by the Plaintiff.
