ORDER GRANTING PLAINTIFF’S MOTIONFOR JUDICIAL NOTICE OF THE MEDICARE PART BPHYSICIAN FEE SCHEDULE AND CMS.GOV

THIS CAUSE having come before the Court on May 31, 2016, upon Plaintiff’s Motion for Judicial Notice of the Medicare Part B Physician Fee Schedule and CMS.Gov, and the court having considered the motion, having heard argument of counsel and being otherwise fully advised, it is hereupon

ORDERED that Plaintiff’s Motion for Judicial Notice of the Medicare Part B Physician Fee Schedule and CMS.Gov, Florida is GRANTED.

Plaintiff has given timely written notice of the request, proof of which has been filed with the Court, to enable Defendant to prepare to meet the request, and has furnished the Court with sufficient information to enable it to take judicial notice of the matter. More particularly, the Medicare Part B Physician Fee Schedule, constitutes “facts that are not subject to dispute because they are capable of accurate and ready determination” by resort to CMS.gov, the federal government website managed by the Centers for Medicare & Medicaid Service, the entity that administers Medicare, a source “whose accuracy cannot be questioned.” §§ 90.202, 90.203, Fla. Stat.
