THIS CAUSE came before the Court on the 24th of August on Defendant’s Motion for Leave to Amend Answer and Amend Answer and Affirmative Defense, and after hearing argument of counsel, it is
ORDERED AND ADJUDGED:
DENIED. This Court finds that CPT Code 72052 is a collateral issue and was already withdrawn. Defendant had notice of this issue for at least two years and didn’t amend. The Defendant’s Answer to Plaintiff’s Amended Complaint filed on November 11, 2014, stands.
