ORDER ON DEFENDANT’S MOTION TODISMISS OR TO TRANSFER VENUE BASEDON MANDATORY FORUM SELECTIONCLAUSE, OR IN ALTERNATIVE,FORUM NON CONVENIENS
This cause came on for consideration by the undersigned on the Defendant’s Motion to Dismiss or to Transfer Venue Based on Mandatory Forum Selection Clause, or in Alternative, Forum Non Conveniens, a hearing was held October 31, 2018, and court having heard argument and considered the motion it is hereby ORDERED AND ADJUDGED:
The Defendant’s Motion to Dismiss or to Transfer Venue Based on Mandatory Forum Selection Clause, or in Alternative, Forum Non Conveniens is GRANTED. The Court grants the Defendant’s Motion to Transfer the present action to Hillsborough County, Florida. The decision is based on the forum selection clause. This case shall be transferred to Hillsborough County within 20 days of entry of this order and the Defendant shall respond to Plaintiff’s Complaint within 20 days after this case has been transferred. The Defendant has agreed to pay for the costs and fees associated with such transfer.
