ORDER

THIS CAUSE having come before the Court on June 23, 1999, on Defendant’s Motion to Dismiss and the Court having heard arguments from parties appearing through counsel, it is hereby:

ORDERED and ADJUDGED that the court makes an instanter finding that the Plaintiff served a Demand for Arbitration upon the Defendant on December 29, 1998. It is further;

ORDERED and ADJUDGED that the Defendant’s Motion to Dismiss is DENIED. Defendant shall file a responsive pleading within twenty (20) days from the date of this order. It is further;

ORDERED and ADJUDGED that Defendant’s Motion to Compel Arbitration is not ruled upon at this point.
