ORDER GRANTING PLAINTIFF’S PARTIAL SUMMARY JUDGMENT

THIS CAUSE having come before the Court on November 8, 2000, on Plaintiff’s Motion for Partial Summary Judgment, both parties appearing through counsel and the Court having heard argument of counsels, it is hereby:

ORDERED and ADJUDGED that Plaintiff’s Motion for Partial Summary Judgment is GRANTED in as much as Defendant failed to pay statutory interest on overdue payments to Schramek, LMT, for treatment rendered on dates of service June 15, 1998 through July 15, 1998. Government Employees Insurance Co. v. Michelle Figueroa 7 F.L.W. Supp. 505 (13th Judicial Circuit, (Appellate) Hillsborough County, Appeal Case No. 99-4386, May 22, 2000, Edward H. Ward, Judge); Joanna McNally v. Allstate Insurance Company, 5 Fla. L. Wkly. Supp. 632 (20th Judicial Circuit, May 14, 1998.).

The Court reserves ruling on the amount of interest awarded to Plaintiff.

The Court reserves ruling on the amount of attorney’s fees.
