ORDER GRANTING PLAINTIFF’S MOTION TO COMPELSUPPLEMENTAL DEPOSITION AND PLAINTIFF’SMOTION TO COMPEL DISCOVERY

THIS MATTER having come before the Court on November 1, 2001, on Plaintiff’s Motion to Compel Supplemental Deposition and Plaintiffs Motion to Compel Discovery and the Court having heard argument of all counsel, it is hereby:

ORDERED AND ADJUDGED as follows:

1. Plaintiff’s Motion to Compel Supplemental Deposition of adjuster Tiffany Peterson is hereby GRANTED as to the issue of indemnification raised in Defendant’s Amended Motion for Summary Judgment.

2. Plaintiff’s Motion to Compel Discovery is hereby GRANTED. Third Party Vendor, Florida Claims Management, the company who scheduled the IME’s and selected the independent medical examiners in this claim at the request of the Defendant, shall provide the following information to Plaintiff.

a) The total amounts paid to the IME physicians via 1099’s for the last three calendar years.

b) The total amounts paid by NATIONWIDE via 1099’s to Florida Claims Management for the last three calendar years.

c) All independent medical examinations ever performed by the respective IME’s physicians in this claim at the request of Florida Claims Management. Said reports shall be provided in re-dacted fashion so as to not divulge patient names.

Plaintiff shall arrange for a neutral party copying company to go to Florida Claims Management to pull, re-dact and copy the records at the instruction of Florida Claims Management. Plaintiff shall pay the costs associated with said copying.
