Angry McDonald’s customer gets shot during struggle after being denied service: Polk deputies

A customer at a Polk County McDonald’s was shot during a dispute over being denied service late at night.

At around 3 a.m. on Oct. 12, P S, 19, and NJ, 18, were denied service at a McDonald’s in Davenport due to the restaurant being too busy, according to Polk County Sheriff’s Office arrest reports.

The pair argued with the drive-thru employee, who was identified as YS, 21, and allegedly told him they would “beat his a**” and wait for him in the parking lot. They walked into the lobby of the restaurant and continued the argument.

The store manager tried to de-escalate the situation and told S and J to leave the store, but the arrest report said they refused. She told deputies she heard the men reference firearms, mentioning a “30 clip” and “switches.”

The arrest report said S went into the break room and grabbed a gun from a backpack. He left the restaurant through the back door and reentered through the lobby, approaching the two men from behind.

A struggle ensued and the gun fired, striking S in the neck. His injury was considered non-life-threatening. The men then left the restaurant.

PCSO said S put the gun in his waistband, grabbed his backpack and picked up the spent shell casing “telling an employee that ‘it belonged to him’,” before leaving the restaurant.

Deputies found the casing and the clothing S was wearing at the time of the incident while searching his home, according to the arrest report. PCSO said he admitted to removing that piece of evidence from the site of the shooting.

S was charged with tampering with physical evidence. S and J were charged with disorderly conduct and trespassing.
