Cape Coral man accused of DUI and nearly hitting officers during traffic stop

A Cape Coral man was arrested early Saturday morning after being accused of DUI and violating Florida’s ‘Move Over’ law.

According to the Cape Coral Police Department, officers were conducting a traffic stop near 4400 Chiquita Blvd. when a truck passed right by them at a very high speed at around 2:15 a.m.

The truck did not move over from the lane closest to the officers and passed within five feet of them, which violates Florida’s ‘Move Over’ law.

Florida’s ‘Move Over’ law states that drivers should move over a lane or slow down to 20 mph below the speed limit when getting close to any stopped vehicle on the side of the road that has hazard lights or other emergency signals on.

An officer then pursued the truck and drove over 100 mph to catch up to it. The officer then pulled the truck over and identified the driver as TJ, 22.

Officers say J told them he was coming from a friend’s house and that he had been drinking earlier in the night. Officers noted that J had watery eyes, slurred speech, and smelled like alcohol.

J agreed to perform standard sobriety test exercises and, based on the results, was arrested for DUI. Officers said they also found an empty case of Twisted Tea and two empty bottles in Janson’s truck.

J was transported to the Lee County Jail and faces one charge of DUI and was cited for violating the ‘Move Over’ law.
