An Administrative Complaint was filed against an IME doctor in Tampa. According to the complaint, the IME doctor received two MRI reports showing a possible labrum tear in the left shoulder and disc herniations in the cervical spine.
Here are some blurbs from the Complaint you may find interesting. A pdf of the entire Complaint can be seen by clicking HERE.
A reasonably prudent chiropractic physician performing an IME under similar circumstances and conditions would have:
-viewed the MRIs and appreciated the clinical significance of the findings.
-obtained radiologic reports related to the MRIs prior to writing the report.
-determined that further chiropractic care was medically necessary and reasonable in light of the MRI findings.
In the alternative, the IME doctor was aware of the MRI findings and CHOSE TO LEAVE THEM OUT OF HIS MAY 3, 2012 REPORT TO MISLEAD OR DECEIVE ANY RECIPIENT OF THE REPORT REGARDING THE FULL EXTENT OF PATIENT A.G.S INJURIES.
Start sending people with video cameras to the IMEs. If they don’t allow the video camera in the exam room then they don’t get to do the IME. Simple as that.
