A Marion County man claims he sustained significant personal injuries after he tripped over an aisle cap while switching aisles.
Attorneys representing JH have filed a lawsuit against Holiday CVS, LLC, (which does business as CVS Drug Store #5231), in the Fifth Judicial Circuit Court of Marion County on September 4.
According to the complaint, H, who is identified as a Marion County resident, was visiting the CVS located 7563 SE Maricamp Road in Ocala on February 5, 2025, at around 1 p.m., to “shop for a short period of time.”
As H rounded the end of an aisle, he allegedly “tripped and fell forward with force” over an “inconspicuous, unattended, unmarked, empty aisle end cap, which was partially blocking the adjacent walkway.”
As a result of the fall, H claims he sustained significant personal injuries.
The lawsuit accuses CVS of creating a “foreseeable zone of risk” and of negligent actions that led to the creation of the dangerous condition. It suggests that CVS failed to maintain its premises, created a tripping hazard to the public, and failed to mitigate the hazard.
“At all times material hereto, CVS owed H a duty to maintain their premises in a reasonably safe condition,” reads the complaint. It goes on to state that CVS should have known or warned visitors about the condition.
As a result of the alleged incident, H claims he sustained permanent injuries and that he’s suffered medical expenses and hospitalization expenses, saying he will continue to experience the losses into the future.
H is seeking over $50,000 in damages, exclusive of attorney’s fees. H is represented by Orlando-based law firm Morgan & Morgan.
