Delivery driver sues Summerfield homeowner over dog attack

In a lawsuit filed against a Summerfield homeowner, a delivery driver claims she was viciously attacked by the homeowner’s dogs while she was making a delivery. 

A N. G filed the complaint in the Fifth Judicial Circuit Court of Marion County on Feb. 11. 

The incident allegedly occurred on July 7, 2025, at a property located at 3334 SE 138th Place.

The lawsuit alleges that multiple dogs owned by LCJC suddenly attacked and bit G without provocation.

The filing asserts that the defendant knew, or should have known, that the animals posed an unreasonable risk of harm and failed to provide any warning to individuals entering the property.

Specific allegations of negligence against the homeowner include allowing dangerous animals to reside on the premises, failing to keep the property safe and free from the threat of animal attacks, and neglecting to warn the delivery driver of the dogs’ dangerous propensities.

The complaint notes that G suffered bodily injury, disability, scarring, disfigurement, and mental anguish.

Additionally, the suit claims G faces ongoing medical expenses, a loss of ability to earn money, and a loss of capacity for the enjoyment of life.

The lawsuit, filed by Jessica F. Carroll of The Schiller Kessler Group, brings counts of both strict liability and negligence.

Under Florida Statute Section 767.04, dog owners are held liable for bites that occur when a person is lawfully on their property, regardless of the animal’s prior history or the owner’s knowledge of its temperament.

LCJC has not yet filed a formal response to the allegations in the Marion County Circuit Court.

G is seeking damages in excess of $50,000, citing severe and permanent injuries.
