Fired Titusville police chief cited after SUV crash, city council member says

A former Titusville police chief was cited for careless driving after crashing a city-owned SUV in June, according to a Titusville City Council member.

The citation was revealed during a city council meeting on Tuesday, nearly a month after L was fired for refusing a breathalyzer test requested by his own department, which is against city policy.

The Florida Highway Patrol, which is leading the investigation, previously stated that L would not face criminal charges.

Troopers at the scene of the crash reported no signs of impairment, despite finding a partially consumed bottle of vodka inside the vehicle. FHP said the presence of alcohol in the car was not sufficient to pursue a DUI investigation.

However, a responding Titusville officer noted that L’s eyes were bloodshot, there was a slight smell of alcohol and he was slurring his speech.

Titusville Mayor Dan Diesel has previously stated that the city could not take further action beyond L’s termination because the crash occurred outside city limits.

At the city council meeting, council member Jo Lynn Nelson addressed the situation, saying, “This unfortunate incident happened. He did get a ticket. He was charged with careless driving. There was no breathalyzer, because there was no probable cause to believe he was under the influence, and unless you have probable cause, you can’t ask for a breathalyzer.”

A criminal defense attorney told WESH 2 that the lack of clear signs of impairment can complicate DUI cases.
