A homeless man in Leesburg was arrested for battery after allegedly hitting a customer with a dustpan taken from an employee at Kangaroo Express.
An officer responded to Kangaroo Express, located at 11025 U.S. Hwy. 441, regarding a battery around 12:11 a.m. Christmas Eve, according to an arrest report from the Leesburg Police Department. Dispatch advised that they received a call from a female employee who stated a customer had been struck in the face by an unknown male, later identified as 24-year-old D S. He left the area while the customer remained inside the locked business.
Upon arrival, the officer met with the victim and the employee. Other responding officers searched the surrounding area for S, and one of them noticed a silhouette inside a nearby bush outside Arby’s. The officer called out, and S emerged from the bush to be detained, the report said.
While speaking with the victim, he told the officer that he and the employee were sitting outside at the front of the business talking. S suddenly emerged from a nearby bush and struck a street sign with his hand. The employee instructed him to “not hurt himself,” which was when he walked up to the victim and struck him with a closed fist below his left eye, the report said.
S then took a dustpan from the employee’s hand and hit the victim on the left side of his face with it. He then walked away headed westbound. Both the victim and the employee went inside the business, locked the door and contacted law enforcement. The victim sustained a red, swollen bump on the left side of his face, the report said.
The employee corroborated the victim’s statement, stating she saw S appear irate and screaming before striking a street sign with his hand. He then approached them and struck the victim on the left side of his face with a closed fist. He next grabbed a dustpan from the employee and hit the victim again, the report said.
The employee immediately grabbed the victim, locking herself and him inside the business, and contacted law enforcement. S walked away headed westbound. The report noted that both she and the victim stated they had never seen S before and could not identify him by name.
Due to this, a show-up was orchestrated. The officer escorted the victim to S’ location where he first struggled to see S. However, proper lighting led to the victim identifying S as the person who attacked him, the report said.
S was subsequently arrested on charge of simple battery. The native of Venezuela was transported to Lake County Jail with bond set at $5,000.
