Man shot and killed after allegedly breaking into a car at Orlando apartment complex

A man was shot and killed after allegedly breaking into a car at an apartment complex Thursday morning, the Orlando Police Department said.

It happened around 5:20 a.m. in the gated Summergate Apartments near Conroy Road and Kirkman Road in southwest Orlando.

The shooter, an off-duty corrections officer, remained at the scene, OPD said.

It’s unclear what, if any, charges the shooter may face.

WESH 2 News spoke with criminal defense attorney J R about the OPD investigation that so far hasn’t resulted in any charges for the shooter.

“Under ‘Stand Your Ground,’ there is no duty to retreat, and that is in your home, in your business, or in your vehicle,” R said.

But R pointed out that the justifiable use of deadly force in Florida hinges on whether the shooter was in fear of death or great bodily harm.

“The general rule of thumb is you cannot use deadly force to protect property,” R said, “But in this particular case, you know, we don’t know whether the shooter was inside or outside the vehicle.”

WESH 2 News reached out to OPD asking more questions about whether the shooter or suspected burglar was inside the car during the shooting and whether the shooter owned the vehicle being targeted.

Police responded they could not provide additional information, citing the active investigation.
