An 82-year-old northwest Miami-Dade woman is facing two felony charges after police accused her of attacking her neighbor for trimming a tree on two separate occasions; in the latest incident, on Wednesday, police said she pepper-sprayed the man.
According to an arrest report, in the first case, on Aug. 30, 2023, Mary Elizabeth Sutton hit her 65-year-old neighbor in the face with a stick “while he was on his property cutting the tree that was growing over the chain link fence that separates the residence,” causing him to sustain facial swelling.
Sutton lives in the 200 block of Northwest 105th Street, just outside of Miami Shores.
In the second case, police said they responded to the area at around 11 a.m. Wednesday after Sutton pepper-sprayed her neighbor, who was again trimming the tree from his property, in the face.
Miami-Dade Fire Rescue treated the victim at the scene, police said.
An arrest report states that Sutton told police that her neighbor “had no right to cut her tree that was growing on his property” but did not mention anything about pepper spray.
Police said a records check revealed a probable cause message to arrest her for the Aug. 30 incident in addition to Wednesday’s incident.
Sutton was being held in the Turner Guilford Knight Correctional Center on a $3,000 bond as of Thursday morning.
A Miami-Dade judge found probable cause to charge the octogenarian with two counts of battery on a person 65 or older, a third-degree felony charge.
