Ocala man sues Walmart after slip-and-fall in check out lane

An Ocala man has filed a lawsuit against a local Walmart, claiming he sustained “permanent physical injury” after he allegedly slipped on a liquid while in the checkout lane.

Attorneys representing TM, Jr., filed the lawsuit against Wal-Mart Stores East, LP, in the Fifth Judicial Circuit Court of Marion County on August 18.

According to the complaint, M visited the Walmart at 9570 SW State Road 200 in Ocala on September 7, 2024.

During his visit, M was attempting to check out and exit the retail store when he slipped and fell on a “foreign liquid substance” on the floor of the store.

According to the complaint, the liquid rendered the floor “slippery and/or otherwise unfit for pedestrian traffic.” The complaint alleges the “poorly maintained and slippery floor represented an unreasonably dangerous condition.”

The complaint alleges that Walmart should have known the issue existed for a “sufficient length of time” and that it breached its duty to M by “failing to maintain its premises in a reasonably safe condition.”

“Specifically, [Walmart] failed to clean up and/or ensure that the foreign liquid substance was not on the floor of its premises representing a slipping hazard. [Walmart] further failed to warn [M] of the existence of the unknown foreign liquid substance on the floor of its premises,” reads the complaint.

As a result of the fall, M claims he suffered “permanent physical injury and resulting pain and suffering, disability, disfigurement, mental pain and suffering, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earnings, and loss of ability to earn money,” reads the complaint.

M is seeking more than $50,000 in damages, exclusive of legal costs.

The lawsuit is one of at least four that have been filed against Walmart locations in Ocala this year.

In one incident, a woman claims her foot was fractured by a case of Gatorade that fell from a high shelf. In its response to that lawsuit, Walmart stated that the customer should have “taken greater caution” and failed to use “reasonable care for her own safety” to avoid injury.

In another lawsuit, an elderly man claims he sustained serious injuries after he slipped and fell over an “unmarked, and unwarned elevation change” at an Ocala Walmart. In that case, the elderly man’s attorneys say the elevation change was camouflaged by an outdoor mat in the garden section.
