An Ocala tenant has filed a lawsuit against her landlord, alleging she was injured after she slipped and fell on exterior tiles outside of a home she was renting that were allegedly “inherently slick and naturally prone to slipperiness.”
Attorneys representing LMD filed the lawsuit against JW in the Fifth Judicial Circuit Court of Marion County on August 19.
According to the complaint, D, who is a resident of Marion County, was residing at a rental property located along SW 40th Place in Ocala. The complaint alleges that W is the owner of, maintained, and managed the rental unit in question.
On September 30, 2024, D claims she was exiting through the front door of the home on the property when she unexpectedly “and without warning, slipped and fell with force” on an exterior tiled surface.
The lawsuit alleges that the tile in the area was “inherently slick and naturally prone to slipperiness, especially when exposed to moisture or foot traffic.” It claims the tiles were likely not “slip-resistant” and were not appropriately “rated for use in an outdoor environment/an environment exposed to moisture.”
D’s attorneys accuse the landlord of failing to “keep the premises in a reasonably safe condition, free from any unreasonably dangerous conditions that might foreseeably give rise to injury or damage,” as well as failing to warn D of the alleged unreasonably dangerous condition.
Furthermore, the attorneys accuse W of negligently failing to “exercise reasonable care with respect to providing safe premises to its guests that were free from unreasonably dangerous conditions.”
The complaint claims that D sustained injuries and suffered “physical handicap” and “disfigurement,” among other damages and losses, as a result of the alleged slip-and-fall incident.
D is seeking more than $50,000 in damages, exclusive of attorneys’ fees.
