Silver Springs woman sues Winn-Dixie over slip-and-fall on puddle

A Silver Springs woman claims she was severely injured after slipping on a puddle while she was shopping at a Winn-Dixie in Marion County earlier this year.

Attorneys representing Rhonda Castongue filed the lawsuit against Winn-Dixie Stores, LLC on December 12 in the Fifth Judicial Circuit Court of Marion County.

The incident allegedly occurred on June 29, 2025, at the Winn-Dixie located at 15912 State Road 40 in Silver Springs.

According to the complaint, Castongue was pushing a shopping cart through the aisles when she passed two employees who were attending to a puddle of liquid on the floor.

The filing states that she continued shopping but then “suddenly and unexpectedly” slipped and fell on a “second liquid hazard” that had collected on the floor nearby.

Castongue alleges she did not see the second puddle before slipping in it.

The lawsuit argues that Winn-Dixie owed a duty to maintain the premises in a reasonably safe condition and to warn customers of concealed dangers.

Castongue’s attorneys claim the store breached this duty by failing to inspect the floors and failing to warn her of the hazardous condition.

As a result of the fall, Castongue claims to have sustained serious bodily injuries, physical handicap, disfigurement, and mental pain and suffering.

The complaint also notes that she has suffered a loss of income and incurred medical expenses for her care.

Castongue is seeking in excess of $50,000 in damages, which is the jurisdictional threshold for the circuit court.
