Mother sues Marion County School Board after child is injured at elementary school

The mother of an elementary school student is suing the Marion County School Board after her child was allegedly pushed to the ground by another student and sustained permanent physical injuries.

The complaint was filed by Kaitlyn Ann Nankervis on behalf of her child, identified solely as “C.K.,” against the school board on May 29.

According to the lawsuit, the alleged incident took place on September 15, 2025, at Belleview Santos Elementary School (9600 U.S. Highway 441, Belleview).

Court documents state that C.K. was violently knocked to the ground by another student while attending the school. The forceful push reportedly caused the child to sustain severe and lasting physical injuries.

The lawsuit accuses the school board of breaching its duty to provide reasonable supervision and care for the students under its custody and control. Specifically, the complaint alleges that the school staff negligently failed to monitor student activities, failed to intervene to prevent dangerous behavior, and failed to properly discipline students known to engage in inappropriate actions.

Furthermore, Nankervis’s attorneys argues that the school board failed to provide adequate staffing to ensure a safe environment and neglected to implement necessary policies to protect vulnerable children.

Prior to filing the lawsuit, the family provided written notice of the claim to the state, and sovereign immunity requirements were met after the claim went unresolved for six months.

As a result of the incident, the plaintiff claims the child has suffered permanent physical impairment, significant scarring and disfigurement, mental anguish, and the expense of hospitalization and medical treatment.

Nankervis is demanding a jury trial and over $50,000 in damages for the child’s permanent damages.
