Abe handled a house fire case for us and he was always available to take calls and answer all my questions. His attention to details and covering all the bases is what stands out the most when I look back on how he handled our case. I have dealt with a few attorneys throughout life but Abe honestly is a 10. I could never imagine anyone not being totally satisfied with this Attorney.

Why You Need a Slip and Fall Lawyer in Florida

Florida law says property owners must keep their buildings and land safe for visitors. A good slip and fall lawyer will fight to get you the money you deserve, deal with complicated legal issues, and stop insurance companies from treating you unfairly. Property owners and their insurance companies often try to blame you for the accident. They’ll say the danger was easy to see or that you weren’t paying attention. You especially need a lawyer when you’re badly hurt, when it’s not clear who’s at fault, or when insurance companies won’t treat you fairly. Studies show that people with lawyers get much more money in settlements than people without lawyers.

We offer free consultations for slip and fall victims, and you don’t pay us anything unless we win money for your case.

How Property Owner Responsibility Works in Florida

Florida law requires property owners to keep their property reasonably safe and warn visitors about dangers they know about. However, your legal rights depend on why you were on the property—whether you were a customer, a guest, or someone who wasn’t supposed to be there. Property owners must regularly check their property, fix dangerous problems quickly, and put up warning signs when hazards exist. Our lawyers can help you understand these complicated rules and find everyone who might be responsible, including property owners, management companies, and maintenance workers.

What Money Can You Get After a Florida Slip and Fall?

After a slip and fall accident in Florida, you may be able to get money for all your medical bills (now and in the future), all the wages you lost and money you won’t be able to earn, pain and suffering (which can be a lot for serious injuries), emotional distress, permanent injuries or scars, and more. Slip and fall accidents can cause surprisingly serious injuries, from brain injuries to spine damage, which can mean getting a lot of money. Insurance companies often offer too little money for slip and fall claims. They act like your injuries aren’t serious or say it’s your fault. But our experienced lawyers know how to figure out what your case is really worth and fight to get you the most money possible.

How Do They Decide Who’s at Fault in a Florida Slip and Fall?

Florida uses something called comparative negligence. This means if you were partly at fault, the money you get will be reduced by your percentage of blame. Insurance companies work hard to blame slip and fall victims. They’ll say you should have “watched where you were going” or that the danger was “obvious.” Our team fights back by doing complete investigations, taking photos and measurements of the dangerous condition, looking at security camera videos, talking to safety experts, interviewing people who saw what happened, and checking the property owner’s maintenance records. We build strong cases that prove who’s really at fault and protect you from unfair blame.

How Do I File an Insurance Claim After a Florida Slip and Fall?

After making sure you get medical help and writing down what happened (if you can), you should tell the property owner or manager right away and make sure they write an incident report. You’ll need to contact the property owner’s liability insurance company to make a claim. But be very careful when talking to insurance adjusters because their job is to pay you as little as possible or deny your claim completely. Before you tell them anything, contact our office for free help. We can talk to the insurance company for you while you focus on getting better, making sure your rights are protected the whole time.

What to Do When Insurance Denies Your Slip and Fall Claim

Insurance companies often deny slip and fall claims or offer too little money. They’ll argue that the danger was obvious, that you weren’t paying attention, or that your injuries aren’t as bad as you say. If your claim gets denied or they offer you too little money, don’t give up. Our lawyers can look at all your options, including gathering more evidence to make your case stronger, finding other people or companies who might be responsible (like property management companies, maintenance contractors, or product manufacturers), or taking the case to court when insurance companies act unfairly. Don’t think you’re out of options—call us to see what we can do.

What Property Owners Must Do in Florida

Florida property owners have many responsibilities to prevent slip and fall accidents, including:

  • Checking regularly for dangerous conditions
  • Cleaning up spills and trash quickly
  • Having good lighting everywhere
  • Keeping floors, walkways, and stairs in good condition
  • Putting up warning signs for temporary dangers
  • Using proper floor mats and drainage
  • Fixing damaged floors or walkways quickly

When property owners don’t do these things, they can be held responsible for injuries that happen. Our lawyers can look at what happened in your accident and figure out if the property owner did what they were supposed to do to keep you safe.

Common Injuries from Slip and Fall Accidents in Florida

Slip and fall accidents cause thousands of serious injuries every year in Florida. Older adults are especially likely to get badly hurt.

These injuries often include:

  • Brain injuries and concussions
  • Spinal cord injuries and back damage
  • Broken hips (especially in elderly people)
  • Broken bones and bad fractures
  • Shoulder injuries and torn rotator cuffs
  • Broken wrists and arms from trying to catch yourself
  • Knee and ankle injuries
  • Nerve damage
  • Pulled muscles and sprains
  • Trauma and fear of falling again

Slip and fall accidents can cause life-changing injuries, especially for older people who may never fully recover. Our team works with medical experts to document all your injuries and how they’ll affect your life and finances in the long run.

Common Causes of Slip and Fall Accidents in Florida

  1. Wet and Slippery Floors: The most common cause of slip and fall accidents in Florida is wet floors from spills, cleaning, leaks, or rain tracked inside. Many businesses don’t dry floors quickly enough or put up warning signs.
  2. Uneven Surfaces and Things to Trip Over: Cracked sidewalks, uneven floors, torn carpet, loose floorboards, and unexpected steps cause many falls. These dangers are especially bad when the lighting is poor.
  3. Bad Lighting: Not enough light in stairways, parking lots, hallways, and entrances makes it hard for visitors to see dangers, which makes falls much more likely.
  4. Weather-Related Dangers: Florida’s frequent rain creates slippery entrances, parking lots, and walkways. Property owners must deal with these expected problems by having proper drainage, mats, and maintenance.
  5. Cluttered Walkways and Obstacles: Products, cords, boxes, and equipment left in walkways create dangerous trip hazards, especially in stores and office buildings.
  6. Broken or Missing Handrails: Stairs without proper handrails or with broken railings cause many serious fall injuries, especially for elderly visitors and people who have trouble walking.

Florida’s Time Limit for Filing Slip and Fall Claims

Since March 2023, Florida law gives you just two years to file a lawsuit after a slip and fall accident. This used to be four years but was reduced. This deadline applies to all injury cases on property that happened on or after March 24, 2023. Property damage claims still have a four-year limit. Special timelines include two years from the date of death for wrongful death cases and three years for claims against government entities.

Time is critical. If you miss this deadline, you permanently lose your right to get any money, no matter how strong your case is. Get medical attention right away, gather evidence quickly (including photos and witness information), and contact a slip and fall lawyer as soon as possible to protect your legal rights and give yourself the best chance of getting fair compensation.
