DUI suspect arrested after crash near Burger King in Leesburg

An Ocklawaha man was arrested on suspicion of drunk driving after causing a traffic accident near a Burger King.

An officer responded to a single vehicle accident with airbag deployment near Burger King, located at 1201 N. 14th Street, around 9:04 p.m. Tuesday, according to an arrest report from the Leesburg Police Department. 

The officer arrived at the scene to see an orange two-door Ford Mustang and its registered owner, 31-year-old Jonathan James Petrone, getting out of it. He used the door for support as he exited the vehicle, the report said. 

The officer asked Petrone if he was okay, and he stated yes in a mush mouth state. He called for EMS to come to the scene and medically assess Petrone. While speaking with him, the officer smelled the strong odor of alcoholic beverage coming from his person, along with his facial and head area to be sweating profusely, speaking in a mush mouth state, mumbling and slurring his words, the report said. 

EMS arrived on scene, at which time they tried to evaluate Petrone, but he became argumentative and refused treatment. The officer asked him to walk with him over to a well-lit area of the parking to perform field sobriety exercises. Petrone agreed, although the report noted he was unsteady and swaying while walking. 

Petrone took a wide stance once he made it to the observation area. The officer asked him if he would submit to field sobriety exercises, but he refused to perform. The officer explained that without him submitting to the exercises, the officer would only have the observations of the scene and of his person. Petrone was still refused, the report said. 

Petrone was then taken to the LPD for the booking process. An officer read him implied consent due to him refusing to submit to a breath test or give a urine sample, the report said. 

The native of Thailand was charged with DUI (accident/property damage or minor injury). He was transported to Lake County Jail and released after posting $2,500 bond.
