ORDER ON PLAINTIFF’S MOTION TO COMPEL RESPONSES/BETTER RESPONSES TO PLAINTIFF’S REQUEST TO PRODUCE REGARDING ATTORNEY’SFEES AND COSTS

This cause came on for consideration by the undersigned on the Plaintiff’s Motion to Compel Responses/Better Responses to Plaintiff’s Request to Produce Regarding Attorney’s Fees and Costs, a hearing was held November 15, 2010, and court having heard argument and considered the motion, having viewed appropriate case law, and relying upon the findings contained within the record of this hearing as well as the finding by this Court that the billing records reflecting the time spent by Defendant’s counsel are relevant to the Plaintiff’s claim for attorney fees, it is hereby

ORDERED AND ADJUDGED:

A. Plaintiff’s Motion to Compel “[a]ny and all attorney, paralegal, assistant and/or secretary time sheets related to this case” from the Defendant in this matter is GRANTED.

B. The Defendant may redact any privileged information contained within the time sheets including but not limited to the hourly rate charged by counsel for the Defendant.

C. The Defendant shall not redact any non-privileged information.

D. The Defendant shall produce to counsel for the Plaintiff the documents described in the Paragraphs above no later than close of business on November 16, 2010.
