Man Dies at Manor Care Boynton Beach, Facility Sued for Incompetence

Manor Care of Boynton Beach, now known as ProMedica, is facing a major lawsuit just filed in Palm Beach County Circuit Court. The suit was filed two years after a patient died — allegedly at the hands of incompetent staffers.

The case, which seeks in excess of the statutory minimum of $50,000 for filing in circuit courts, focuses on a man who was identified as a “fall risk” actually falling. Multiple times. The falls, according to the suit, led to his death. Here’s part of what attorneys allege in the complaint obtained by BocaNewsNow.com.

“On or about May 25, 2022, MARTIN SKLAR became a resident at the Defendant, MANOR CARE OF BOYNTON BEACH FL, LLC. At all times material hereto, MARTIN SKLAR, had an unsteady gait, impaired balance, poor safety awareness, a history of prior falls, was confused, and was a high fall risk. On or about September 30, 2022, MARTIN SKLAR suffered a fall at the Defendant facility. On or about October 4, 2022, MARTIN SKLAR suffered a fall at the Defendant facility. On or about October 6, 2022, MARTIN SKLAR was transferred to Delray Medical Center wherein he was diagnosed with multiple rib fractures caused by the October 4, 2022 fall, resulting in multiple surgeries. As a direct and proximate result of the negligence of the Defendants as described herein, MARTIN SKLAR died on October 15, 2022 as a result of complications from blunt trauma of the torso.”

ProMedica which operates several facilities in South Florida, did not file an immediate response that was processed by the Palm Beach County Clerk of Courts as of 7:40 a.m. Thursday.
