A Notice created using this system is intended to meet a portion of legal requirements set forth in Section 627.70152, Florida Statutes, which requires a claimant to file Notice with the Department of intent to initiate litigation at least 10 business days prior to filing suit under the policy, but not be given before the insurer has made a determination of coverage under Section 627.70131, Florida Statutes.
The Department provides this form for completion and transmits it to the insurer and the claimant pursuant to Section 627.70152, Florida Statutes. This form is not a complaint or inquiry made pursuant to Section 624.307, Florida Statutes and shall not be handled as such.
