A Fruitland Park woman was arrested for battery after allegedly punching her soon-to-be ex-husband.
An officer responded to a battery at an undisclosed Lake County residence around 5:27 p.m. Jan. 14, according to an arrest report from the Fruitland Park Police Department.
Upon arrival, the officer met with the male victim who advised he had returned home from work at around 5:10 p.m. and found his soon-to-be ex-wife, 38-year-old MM S, inside with the children. To avoid an altercation, he walked outside, to which S and their four children followed. She then stated she was not going to leave, the report said.
The victim advised that he called S’s grandmother, as she had been wanting to talk to S for a while but could not because she was blocked in her phone. S got upset because she did not want to talk to her grandmother and tried to take his phone to hang up. She was unable to get the phone and struck the victim in the face with a closed fist instead. She then left, saying she was going to talk to her lawyer, the report said.
The officer spoke to all four children individually, and they all stated they witnessed the incident. Their side of the story matched what the victim told law enforcement, the report said.
The report noted the victim and S were currently still legally married and had four kids in common, though they no longer lived together.
S left the residence prior to the officer’s arrival, but he was able to contact her over the phone. She stated she was staying at 2101 Live Oak Dr. When the officer got there, she advised that she did not strike the victim. She stated he was the one being aggressive, the report said.
Based on the totality of circumstances, the officer arrested S on charge of simple battery (domestic). The Texas native was transported to Lake County Jail and released after posting $1,000 bond.
